Trump reverses Obama-era race guidelines for admissions

Trump's Democratic predecessor, Barack Obama, had issued two sets of admissions to colleges as well as elementary and secondary schools "on the voluntary use of race to achieve diversity", saying educational institutions had a "compelling interest" in doing so.

The following year, the Bush administration advised schools to use "race-neutral methods" to determine where children go to school, suggesting that officials use socioeconomic status instead of race.

The shift gives schools and colleges the federal government's blessing to leave race out of admissions and enrollment decisions and underscores the contentious politics that for decades have surrounded affirmation action policies, which have repeatedly been challenged before the Supreme Court.

But Anurima Bhargava, who monitored civil rights enforcement in schools under Obama's Justice Department says that the Trump administration is just trying to decrease diversity in higher education.

That means Democrats have a steep hill to climb if they intend to preserve the decisions on groundbreaking cases like Roe V. Collins quoted Chief Justice John Roberts, who called stare decisis a "fundamental principle of our judicial system".

Trump officials said that the Obama administration overstepped its authority by going beyond what the Supreme Court has said in affirmative-action cases. "This is a purely political attack that benefits nobody".

The Republican Trump administration's move is being viewed by Democrats and liberals as a way to weaken affirmative action.

The Justice Department has already made clear its position on the matter, and back in November, the Wall Street Journal confirmed that the department had launched a probe into Harvard's admissions policies after it received a civil rights complaint from a coalition of 60 Asian-American groups alleging bias from the university. However, the action does suggest that the federal government will be more willing to investigate complaints by applicants that they were denied entrance to a particular college due to their race, experts said. As Peter Wood said at the time, the guidance documents "seem to sanction common university practices which circumvent the law".

"We're now looking at a post-Kennedy Supreme Court". "It is more evidence that the Trump administration is skeptical about race-based decision-making in admissions and in other contexts".

A lawsuit against Harvard over the alleged discrimination against Asian-Americans is working its way through the courts now.

The studies were filed in Boston's federal court as both sides attempted to persuade a judge to end the suit before it reaches trial, which has been scheduled to start in October.
