Boeing has argued that the Embraer plane is a regional jet that doesn't compete with the C Series or Boeing's 737.
Bombardier spokesman Simon Letendre said the company and Airbus will proceed with the construction of the second assembly line for the USA market. Its wings are built in Belfast, Northern Ireland.
Delta was expected to receive the first of its firm order for 75 CS100 planes in the spring, but now plans to wait until the aircraft destined for US customers is built in Mobile, Alabama.
"The sophisticated process for assembly high-technology large civil aircraft, significant employment, and share of US content planned for the new U.S".
Executives at both airframers said the plan eliminated the threat of import taxes because US-made CSeries would not be subject to the duties.
Immediately following the ruling Airbus tweeted: "We are happy to see that the ITC concurred with our views".

So far, 127 witnesses have been interviewed, but the list of people that detectives still need to speak with is growing, she said. Toronto police were seen leaving the Sherman household Friday morning, taking down yellow tape from the crime scene.
He told the commission that "Boeing simply was not in the mix".
She added: "When the story is told of this dispute it will be one of how, in the absence of a genuine effort by politicians and the United Kingdom government, workers themselves had to take the fight on".
The four current commissioners were appointed by presidents Barack Obama and George W. Bush. On Tuesday, the administration imposed tariffs on imported solar-energy components and large washing machines.
The company can now proceed with the delivery of 75 CSeries jets to Delta Air Lines, originally scheduled to begin in the spring.
While Bombardier called the ITC's decision a victory for "innovation, competition and the rule of law" as well as for "U.S. airlines and the traveling public", Boeing suggested it may not be quite ready to let the fight go.

Boeing claimed Bombardier was able to sell the aircraft at "absurdly low prices" in the United States after receiving $3 billion in government subsidies.
The ITC ruled Boeing had not made the case it suffered damages from the Canadian rival, whose planes have yet to enter the US market.
Standing on that principle now looks costly. A CNBC report described the ITC ruling as "a surprise decision".
"The threat of a new petition-which Boeing has not disclaimed-makes the partnership with Airbus to build a USA full assembly line a necessity regardless of how this case is resolved", the Montreal-based manufacturer wrote in a 20-page submission.
It has options to buy out the smaller CSeries stakes of Bombardier and the government of Quebec, meaning it could take full ownership around 2026. Most observers, including Bombardier and the Canadian government, had expected Bombardier to lose its case.
Now that court has delivered its verdict, and Boeing lost. "With this matter behind us, we are moving full speed ahead with finalizing our partnership with Airbus", which partnered with Bombardier to help manufacture the planes in Alabama. While Marcil said he didn't know whether that swayed the USITC, as the final decision has not yet been released, he said the Airbus deal was still the right thing to do.

However, the highest rise in water level of Seine was in 1910, when the numbers were reported to be as high as 28 feet. In the suburb of Villeneuve-Saint-Georges, flooding forced some residents into boats to move along the roads.
There's just one possible silver lining for Boeing in Friday's outcome. The case raised hackles in the U.K.as well, with the government anxious about the potential fallout for a Bombardier factory in Northern Ireland. "The only way to counter the risk created by Boeing's petition is through a new US full assembly line".
