Boeing has argued that the Embraer plane is a regional jet that doesn't compete with the C Series or Boeing's 737.

Bombardier spokesman Simon Letendre said the company and Airbus will proceed with the construction of the second assembly line for the USA market. Its wings are built in Belfast, Northern Ireland.

Delta was expected to receive the first of its firm order for 75 CS100 planes in the spring, but now plans to wait until the aircraft destined for US customers is built in Mobile, Alabama.

Executives at both airframers said the plan eliminated the threat of import taxes because US-made CSeries would not be subject to the duties.

It has options to buy out the smaller CSeries stakes of Bombardier and the government of Quebec, meaning it could take full ownership around 2026. Most observers, including Bombardier and the Canadian government, had expected Bombardier to lose its case.

Now that court has delivered its verdict, and Boeing lost. "With this matter behind us, we are moving full speed ahead with finalizing our partnership with Airbus", which partnered with Bombardier to help manufacture the planes in Alabama. While Marcil said he didn't know whether that swayed the USITC, as the final decision has not yet been released, he said the Airbus deal was still the right thing to do.
