Between the lines in the complaint, you get the feeling that Crytek has their eyes on a piece of the $150 million+ crowdfunding pie that Star Citizen has amassed. Crytek also states that a relationship was formulated between the two companies both parties entered into a Game License Agreement.(GLA). Saying the company 'utterly failed to follow through on those promises.' in reference to multiple alleged complaints. Problem is Crytek are claiming that they aren't telling the truth. "Notwithstanding that he had confidential information about Crytek's licensing practices that would unfairly advantage Defendants", the complaint states, "Freyermuth never recused himself from those negotiations and never resolved that conflict of interest with Crytek". The negotiations were also led by Carl Jones on behalf of Crytek who later left and became an employee of CIG.
As first reported by PC Gamer, the suit alleges that Crytek originally licensed its engine for use in the game at a below market rate in exchange for prominent display of its trademarks in Star Citizen itself which was obviously off the cards when the development switched engines in December 2016.
This statement now makes little sense and it also contradicts Crytek's claims. The lawsuit goes on to say that Cloud Imperium founder Chris Roberts "publicly sought to minimize Crytek's contribution to Star Citizen".
It includes the CryEngine trademark but not Crytek's. This would breach the GLA according to Crytek. And while some may say that Squadron 42 is just the single-player mode of Star Citizen, the game is being sold as a standalone title, thus giving the impression of a second, separate game. The filling specifically refers to Squadron 42 project. The agreement with Crytek was to only cover one game and therefore CIG would now be breaching the initial agreement.
Then, in June of this year, Crytek say they sent another letter requesting bug fixes and optimisations and that so far CIG and RSI "have not made a good faith effort to provide Crytek with the promised bug fixes and optimizations to the CryEngine as a complete, compilable version".
Crytek claims that CIG's infringement of their deal was "willful, reckless, and/or in blatant disregard for Crytek's rights as a copyright holder".
