Epic Games is now in a heated debate after filling a lawsuit against a 14-year-old boy who was found cheating in Fortnite and live streaming it to his YouTube channel.

One of the gamers, who sued, was a 14-year-old Caleb Rogers. She makes a number of good points, including the fact that Epic is suing for loss of profits even though Fortnite Battle Royale is free-to-play, and that her son didn't actually make the cheats, he just bought them.

"We are constantly working against both the cheaters themselves and the cheat providers".

She takes issue with Epic using her son as a scapegoat, when the company should really be going after the cheat makers.

But the actions weren't enough to stop two prolific cheaters, who constantly created new accounts under false names to circumvent the bans. In addition, the pair live streamed the use of the program in the game.

Fortnite cheaters might have to think twice before doing it again, but so will Epic Games after dealing with this player's mom. Epic Games filed the legal action last month, but it may now regret it.

The mother is also angry that the game's publisher has made her son's name public, which allowed newspapers and other media outlets to easily get access to his name and release other details.

The biggest point of contention revolves around the EULA agreement.

In the end, the child's mother asks that the judge dismiss the case since "the infraction does not equate the suing of a minor by a major gaming company". The first is that minors are not supposed to be able to play the game without parental consent, something she apparently did not give.

This particular lawsuit arose as a result of the defendant filing a DMCA counterclaim to a takedown notice on a YouTube video that exposed and promoted Fortnite Battle Royale cheats and exploits. Epic Games states that "under these circumstances, the law requires that we file suit or drop the claim".

Online multiplayer games on different systems are plagued by people who use cheat codes or take advantage of flaws in the game's inner workings to gain an edge on other players who play fairly.
