Speaking to federal prosecutors in NY two days after a man killed eight people in a terror attack in lower Manhattan, Sessions said the Trump administration would "use all lawful tools at our disposal including prosecution in (federal) courts and at Guantanamo Bay".

DEATH PENALTY!" He had tweeted Wednesday night: "NYC terrorist was happy as he asked to hang ISIS flag in his hospital room.

"He killed 8 people, badly injured 12".

In recommending the death penalty, experts argue, prosecutors will have a much harder time moving forward with this proposal.

"Send him to Gitmo - I would certainly consider that", Trump, using a nickname for Guantanamo, said when asked about that possibility by one reporter. The charges included providing material support to ISIS, violence and destruction of motor vehicles said Joon H. Kim, the acting U.S. Attorney for the Southern District of NY.

The president however didn't seem to mind and reiterated his call again on Thursday morning.

"There is also something appropriate about keeping him in the home of the frightful crime he committed", Trump continued on Thursday.

In a tweet, a seemingly angry Commander-in-Chief wrote that the suspect "SHOULD GET DEATH PENALTY". "But when *you* say it, it makes it harder for DOJ to make that happen", tweeted Andrew McCarthy, the former assistant USA attorney for the Southern District of NY.

Though the tainted drinks initially only killed eight people when they were served last Thursday, the death toll has been rising. Police said that they have registered a case against the woman and were looking for her paramour.

The president has also used Tuesday's attack to call for tighter migration controls after it emerged that Saipov was allowed into the U.S. through a visa "lottery" scheme.

"We have to come up with punishment that's far quicker and far greater than the punishment these animals are getting right now", Trump said in a press conference.

The tweet was one of many from Trump since the attack in NY. "We must get MUCH tougher (and smarter)", he continued in a following tweet.
